    I can't give a lot details except that it was about this Private in the army, he has a brown uniform and is mostly a goof. He pretty much seems to mess everything up. He gets into trouble with his Superior a lot. I was too young to remember much, but it aired around the time when - I dream of Jeannie, Bewitched used to air.

  • What do I do when my soon to-be-in-laws aren't receptive of me?

    I just got engaged and my soon to-be-mother-in-law isn't receptive towards me because I have a weight issue. We now live in the family house. I understand she wants her son to be happy but he is happy with me.

    I am trying to lose the weight. I don't sit around and do nothing about it. I've cut back on food and I go for walks but it seems like she doesn't like the idea of having a fat daughter-in-law.

    I find it quite hard to keep it together. She thinks we're not going to make it and that we won't be happy. She keeps harping on the weight issue and it just makes me feel like I should walk out of this relationship.

    My fiance is very close to his mother. He is caught in the middle. The little things she says gets to me. Like today, he left her car lights on and the car was dead. She said something along the lines of... 'he does this every time... God save whoever is going to marry him'. o_O

    I'm marrying him... that's the reason we got engaged.

    I don't know what to do. I want to be accommodating but it's hard when I'm away from my family and friends. I came to Canada from Singapore to live my life with my fiance. Now I have to see her everyday and have my weight thrown on my face everyday.

    I was always surrounded by people who have accepted me for me and now when she doesn't like me as a person it's taking a toll on my sanity.

    I see from the settings menu that LG Optimus 2X has three different memory -External SD, Internal SD, and Internal Phone Storage. When I access my gallery, it says to delete some unused files on the Internal SD as memory is full. Can you help to explain what the difference is between the Internal Phone Storage and Internal SD card? Also, how do I free up my Internal SD card?

    I used Astro file to access my SD card. My Internal SD card's available storage is 1.03 MB while my Internal Phone Storage is 1.17GB

    Arnold advertised his lorry for sale in the Morning Gazette, a national newspaper. The advertisement specified that the lorry was a '2002 Ford Ranger diesel pick-up - asking price $7000 - Telephone 0123444555'

    Bob telephone Arnold and told he would pay $7000. Arnold replied 'I had hoped for more'. The line went dead before Bob could hear Arnold say, 'but I accept your offer.' Bob sent a text message to Arnold confirming his offer but this was misdirected and went to another number. Two days later Cynthia, a friend of Arnold's, told Bob that Arnold had accepted his offer.

    From the facts of the case, it could be identified that there is a valid contract. There are 4 requirements to be fulfilled in order to determine the existence of a valid contract; as was established by Lord Wilberforce in the Eurymedon. The first being, agreement followed by consideration, intention to create legal relations and no vitiating factors.

    The first requirement; agreement - An agreement is a promise of sets of promises that are binding in law which comprise offer and acceptance. An offer is "an expression of willingness to contract on certain terms, made with the intention that it shall become binding as soon as it is accepted by the person to whom it is addressed" as defined by Prof. Teritel.

    On the facts (OTF) - Arnold had placed an advertisement stating he had a 'Ford...pick-up - asking price $7000'. Prima facie, the status of Arnold's advertisement appears to be an invitation to treat (ITT) - an expression of willingness to negotiate - it indicates the interest of one party to enter into negotiations and is by no means supposed to form a binding contract. Whether the advertisement was an offer or an ITT depends on the intention of the parties as was established in the cases - Carlil v Carbolic Smoke Ball Co. where it was established that it was an offer and in Partridge v Crittenden where is was established that is was an ITT.

    I need to know what that case was. I can't remember the exact details nor citations. I can't even remember who the judge was. I am thinking it could be Lord Wilberforce; I'm not entirely sure.

    Question (1)

    Mrs McLoughlin is claiming damages for psychiatric injury due to the negligence of the defendant. She was affected by the result of the accident which ensued due to the negligence of the respondent, O’Brian; Thomas McLoughlin the claimant’s husband, and 3 of her 4 children, George, Kathleen and Gillian were involved in a motor car collision. Michael one of her 4 children, was in another vehicle driven by a friend of the family’s; which was not involved in the accident.

    The appellent’s husband, Thomas McLoughlin and 3 of her 4 children, George, Kathleen and Gillian, were involved in a motor car accident. Michael, one of her 4 children, was a passenger in another motor car driven by a friend of the family’s: this car was not involved in the accident.

    As a result of the accident, the appellent’s husband, Thomas suffered injuries and shock; George suffered injuries to his head and face and cerebral concussion; Kathleen suffered concussion, bruising and shock. Gillian was so severely injured that she died almost immediately.

    On the 19th October 1973, a friend came to the claimant's (plaintiff's) house to tell her of a serious accident involving her husband and three children, two hours after it had occurred. He drove her to the hospital where her son Michael said Gillian her daughter had died. She saw her husband and two other children seriously injured, all still covered in oil and mud. She suffered serious nervous shock as a result and sued the defendant who was responsible for the accident.

    Question (3)

    When confronted with novel situations, judges do make new laws. Their decisions establish precedents that affect future cases, Lord Wilberforce handled the case with judicial creativity.

    In common law, damages cannot be awarded for grief and sorrow. In psychiatric injury claims, the House of Lords dismissed the public policy argument in the foreseeability and consequently the duty of care issue. Regarding policy and opening the floodgates, any abolition or relaxation of the special rules governing the recovery of damages for psychiatric harm would increase the class of persons who can recover damages in tort. The law in the area of psychiatric harm is thus becoming more complex and inconsistent. Defendants face difficulties of legal uncertainty since this area of law depends on policy considerations. Earlier decisions in English courts had allowed victims to recover damages for emotional injury. This case was unique at the time because the claimant suffered injuries away from the scene of the accident and hours after the accident occurred.

    Can you explain the second formula for loan re-payment. Both yield different monthly payments.

    Given that the Loan amount is 13,000, fixed interest at 5.88% and the re-payment months is 36 months (3 years).

    So I got this from a friend working in a particular bank.

    Formula 1: -

    C= Loan Amt

    R = Int Rate %

    N = Number of Months

    P = Monthly payment

    C X R X N in years = (A)

    C + (A) = (B)

    (B) ÷ N in months = P

    So it would be –

    13000 X 5.88% X 3 = 2293.2

    13000 + 2293.2 = 15293.2

    15293.2 ÷ 36 = 424.81

    Whereas, in another bank it’s calculated with this formula, could you explain as to how this calculation is made. Thank you.
