First, file a claim. Second, sue them if they won't pay.

If they are not willing to pay you what you "think" you deserve, or more than what they have offered you, you have choices. 1) Accept what they ARE willing to pay you or 2) hire a lawyer to fight for you.

Without more details, it is hard to give a really good answer - but here are some basics:

Here is the problem - if you need to try to get the best settlement from YOUR insurance company - then it means that the accident was YOUR FAULT.

You are entitled to whatever your POLICY states and usually nothing more. YOU picked the policy that you are paying for and if you feel you didn't get enough in the settlement - then it means YOU picked a bad policy.

If the accident was someone else's fault and their insurance company isn't covering enough and your insurance company is doing nothing to help you get more - then you are always entitled to get your own lawyer and find out your options.

Most accident attorneys will do a free consultation - so no matter what your situation is, you can always talk to one to see what they think you would be entitled to based on your situation.

Depends on if what you think "you deserve" is reasonable and then negotiate.

If you are skilled at negotiation, you will always receive more without a lawyer because you aren't paying their cut.

Depends on how realistic you're being on what you 'deserve'

by letting a lawyer negotiate it for you and insurance company will often try to give you the lowest possible settlement if you're not represented

They are ALWAYS going to "try to give you the lowest possible settlement". It's not the nature of the business for insurance companies to "give away" money you can't prove you deserve.
