Non living because it has no mind of its own. It just spreads. I mean it may seem like it but it's not even though germs can be bacteria sometimes.

It's debatable. Viruses contain genetic material, RNA or DNA, one of the requirements to life. Their genetic material however is incomplete so they need to attach to a host cell to exhibit the typical activities of a living organism. So they're in between living and non-living. Think of zombies at the intra-cellular level.

Depends on how you classify living.  A virus has DNA/RNA required to replicate but does not have the biological machinery to self replicate.  In order to replicate it invades and uses the biological machinery of the host in order to replicate.

Machinery probably isn't the correct term but for someone who doensn't know about enzymes etc its fine.

It's living and it invades a healthy entity to make it weak.  Much like criminal aliens in a sovereign nation, it must be eradicated or it will kill its host.

The virus does not have any characteristics of the living cell, so they are a non-living thing.

If you are talking about a computer virus, then no, it isn't living. It is a program meant to be set loose in a network to override security protocols and cause damage, but that is all it is~ a program.

If you are talking about a medical virus, then yes, that is a living organism.
