Can a manager at a chipotle restaurant ban a homeless person for entering without a mask, occupying the restroom, and not buying anything?

I witnessed a recent incident and was wondering... if a person is clean with clean garments on too but they visit a chipotle without wearing a mask, without buying anything, occupies one of the restrooms for more than 30 minutes, and argues with any of the workers that say they have to buy something and not come in just for warmth and to occupy the restrooms; even then can a manager at the chipotle restaurant ban that person from the premises and have a good reason to do that?

    Of course they can do this.  If you stop to think, you'll quickly see why.  That person was probably cleaning up in the bathroom, and 30 minutes of water isn't cheap (esp warm water).  If he goes back to the homeless encampment and says they'll let you do this, pretty soon they have a lot of people wanting to do it.  Not only does this cost money, it ties up the restroom for paying customers.  There's almost no restaurant that allows this, whether they're chain or local, big or small.

    Sure can, there are laws that let him do just that, as well as laws against vagrancy as well!

    Short answer: yes they can. Just because a restroom is in a public restaurant, that isn't a reason to open it up to the public who are not restaurant customers. The person can be charged with trespassing.

    Yes, the manager can certainly do that, and can also call the police and have the person removed for trespassing if they refuse to leave. Depending on where you live, some places have clearly stated policies that restrooms are for customers only. If this is a bigger city, there are probably shelters and warming centers open in the winter. Even a place like the public library would be more tolerant of someone coming in to get warm than a restaurant.

    No restaurant owner wants someone in there who's just going to sit there with no food or drink, because customers will wonder what's going on with that person, for one thing. But not wearing a mask?  That's the rule set by the restaurant.  No mask, no service.  Staying in the restroom for over 30 minutes?  That means that customers will complain. That person is trespassing so yes, the manger can ban them.

    Nobody is supposed to live in a restroom. 

  • How are you supposed to eat with a mask on... This manager is rude. If he was doing other things then eating or drinking some thing with out a mask on and not using physical distancing, then he has the right to ask the person to leave. If that's their policy, and they chose to ignore it then they can ban people from a restaurant, or fire workers that don't follow policies.

    You put down a list of reasons all of which if I were the manager I would make it so they aren’t welcome back if they did even just ONE of those actions you stated and especially if they aren’t patronizing the place.

    Of course.  They can refuse service to anyone.

    Yes they can ban him for not wearing a mask.

    They don’t want him to spread COVID-19.
